SUPERVISORS' REPORTS AND COUNTY ADMINISTRATOR'S REPORT
Pursuant to A.R.S. §38-431.02(K), individual Supervisors and the County Administrator may present brief summaries of current events but no discussion may occur and no action may be taken regarding anything that is presented.
 
CONSENT AGENDA All items on the Consent Agenda were unanimously approved.
 
1.   Board of Supervisors - Approve minutes of meeting of September 5, 2018.
 
2.   Board of Supervisors - Approve an Intergovernmental Agreement with Gila County to provide Restoration to Competency Services to Gila County pre-trial detainees. YC Contract No. 2018-450
 
3.   Board of Supervisors - Approve settlement of two property tax appeals, and the refund of the overpayment of taxes pursuant to A.R.S. §42-16214 in the following case(s) filed by Lynx Capital 4, Inc. v. Yavapai County: (TX2017-000541), (TX2018-000069).
 
4.   Board of Supervisors - Approve Amendment #7 to Department of Economic Security (DES) Intergovernmental Agreement Contract #DI16-002118, to increase fund balances for PY 2017 Restoration funding by $7,291.00. YC Contract No. 2018-454
 
5.   Board of Supervisors - Acknowledge the contract between A Quality Excavating, LLC and Yarnell Water Improvement Association, pursuant to the Board's approval of the use of Community Development Block Grant funds for water system improvements in Yarnell.
 
6.   Board of Supervisors - Approve vouchers for August 27, 2018 through September 7, 2018.
 
7.   County Attorney - Approve agreement and funding of $40,000.00 from the Arizona Governor's Office of Youth, Faith & Family to support the Arizona Annual Drug Summit to be held in Phoenix, AZ, September 24-25, 2018. Monies to be deposited into Fund 673. YC Contract No. 2018-452
 
8.   Fleet Management - Approve purchase of replacement vehicles through the Arizona Counter Drug Procurement 1122 Program and state contract procurement. (All Districts)
 
9.   Fleet Management - Approve request to purchase a previously owned forklift using general fund contingency and transfer budget capacity as needed, not to exceed $22,000.00. The forklift will replace forklift #955500 located at Yavapai County Sheriff's Office Evidence Building, which will be auctioned.
 
10.   Fleet Management - Approve an additional vehicle to be assigned to the Medical Examiner's Office (MEO).
 
11.   Flood Control District - The Board of Supervisors will resolve into the Board of Directors of the Yavapai County Flood Control District, and following consideration of this item will reconvene as the Board of Supervisors - Approve FY 2018-19 funding in the amount of $600,000.00 for a new Community Intergovernmental Agreement (IGA) with the Town of Prescott Valley for the drainage component of the Sunset Lane Improvements Project. YC Contract No. 2018-455
 
12.   Geographical Information Systems - Approve reclassification of a GIS Cartography Entry position to a GIS Programmer/Analyst I position in the Geographic Information Systems (GIS) Department.
 
13.   Jail District - The Board of Supervisors will resolve into the Board of Directors of the Yavapai County Jail District and following consideration of the following item(s) will reconvene as the Board of Supervisors - Approve Intergovernmental Agreement YH16-0028-13 for Arizona Health Care Cost Containment System (AHCCCS) to establish procedures to accommodate AHCCCS eligibility suspension at the time of incarceration, reinstatement of an individuals enrollment upon release from incarceration and transmission of match results to the County for County's use in discharge planning of inmates to be released. YC Contract No. 2018-451
 
14.   Management Information Systems - Approve entry into a five (5) year contract with CenturyLink to expand Internet network connectivity services from 200Mbs to 600Mbs. YC Contract No. 2018-453
 
15.   Public Works - Approve acceptance of purchased roadway easement on APN 106-29-260A at N. Ca-Tim Drive in the Ho-Kay-Gan Village Subdivision. (District 4 -Supervisor Brown)
 
16.   Public Works - Approve Change Order #1 for extension to April 1, 2019, for completion of services of Authorization of Services #1822210.2 with Civiltec Engineering, Inc. YC Contract No. 2018-099A1 (District 4 - Supervisor Brown)
 
17.   Public Works - Approve Change Order #1 for extension to April 1, 2019, for completion of services of Authorization of Services #1722057.1 with Engineering & Testing Consultants, Inc. (ETC). YC Contract No. 2018-137A1 (District 3 - Supervisor Garrison)

Public Works - Approve the purchase of four (4) replacement vehicles and one (1) new vehicle for Public Works as budgeted in FY18-19. (All Districts)
 
19.   School Superintendent - Approve the temporary waiver of Human Resources Policy 2.01 Section II, D and E.
 
20.   School Superintendent - Approve agreements for E-Rate Consulting Services between the Yavapai County School Superintendent and the following schools: The Orme School - YC Contract No. 2018-338 and Somerton School District #11 - YC Contract No. 2018-241.
 
21.   Sheriff - Approve two (2) employees to attend the Crisis Negotiations Conference on October 29, 2018 through November 2, 2018, in Phoenix, Arizona.
 
ACTION
 
1.   Board of Supervisors - Approve Proclamation declaring September 21, 2018, as POW/MIA Recognition Day in Yavapai County. Approved
 
2.   Board of Supervisors - Approve Proclamation declaring October as Breast Cancer Awareness Month in Yavapai County. Approved
 
3.   Board of Supervisors - Discussion and possible action on Preliminary Awards of Title III Forest Fees Projects in the amount of $275,000.00. (Phil Bourdon, County Administrator; Dan Cherry, Public Works Director) Approved
 
4.   Board of Supervisors - Discussion and possible direction regarding joining design efforts with the Town of Prescott Valley on sidewalk adjacent to County property in the Prescott Valley Civic Center. (District 5 - Supervisor Smith) Approved
 
5.   Board of Supervisors - Consider approval of a letter of commitment to the Northern Arizona Council of Governments (NACOG) to participate as a team member of NACOG's application for Fiscal Year 2019 Brownfields Coalition Assessment Grant. (Phil Bourdon, County Administrator) Approved
 
6.   Board of Supervisors - Discussion and direction on a proposed pilot program for use and operation of Yavapai County heavy equipment by Valley Academy for Career and Technology Education (V'ACTE). Approved
 
7.   County Attorney - Approve Waiver of Conflict regarding agreement with Valley Academy for Career and Technology Education No. 1 pilot program for use and operation of Yavapai County heavy equipment, including any additional contracts, intergovernmental agreements, follow-on agreements, or renewals. Approved
 
HEARINGS
 
1.   Board of Supervisors - Courtesy hearing for adoption of Ordinance 2018-1, an ordinance of the Yavapai County Board of Supervisors regulating portable communication devices and texting while operating a motor vehicle. Final hearing and adoption will be October 3, 2018, at the Board of Supervisors meeting. (All Districts) No Action
 
2.   Development Services - Recommend approval to the Arizona Department of Liquor Licenses and Control of an application for agent change (28091) without protest submitted by Rodney Snapp for Javelina Leap Estate Vineyards located at 1565 Page Springs Rd., Cornville, 86325. (District 2- Supervisor Thurman) Approved
 
3.   Development Services - Recommend approval to the Arizona Department of Liquor Licenses and Control of a Series 11 liquor license application (28322) without protest for Castle Hot Springs Resort located at 5050 E. Castle Hot Springs Rd., Morristown, 85342. (District 1 - Supervisor Simmons) Approved
 
4.   Development Services - Recommend approval to the Arizona Department of Liquor Licenses and Control a Series 12 - Restaurant Liquor License application (28113) without protest submitted by Michael Papa for Harry's Hideaway located at 10990 E. Cornville Rd., Cornville, 86325. (District 2 - Supervisor Thurman) Approved
 
CALL TO THE PUBLIC: Individuals may address the Board for up to three (3) minutes on any relevant issue within the Board's jurisdiction. Pursuant to A.R.S. §38-431.01(H), Board members shall not discuss or take action on matters raised during the call to the public. The Board may direct staff to study the matter or direct that the matter be rescheduled for consideration at a later date.
 
EXECUTIVE SESSION
 
1.   Board of Supervisors - Convene into executive session pursuant to A.R.S. §38-431.03(A)(3) and (A)(4) for legal advice, consultation and discussion regarding the following tax case: Transwestern Pipeline Company, LLC v. Arizona Department of Revenue, et al, TX2016-000931.
 
2.   Board of Supervisors - Convene into executive session pursuant to A.R.S. §38-431.03(A)(1) to discuss and conduct performance appraisals of the Public Fiduciary, Community Health Services Director, Management Information Systems Director and Finance Director.
