Pursuant to A.R.S. §38-431.02(K), individual Supervisors and the County Administrator may present brief summaries of current events but no discussion may occur and no action may be taken regarding anything that is presented.
 
PRESENTATIONS
 
1.   Board of Supervisors - Presentation of the Yavapai County Local Workforce Development Area Director's Award to the Yavapai County Board of Supervisors.
 
CONSENT AGENDA All items on the Consent Agenda were unanimously approved with the exception of items 15 and 34.
 
1.   Board of Supervisors - Approve minutes of meeting of August 1, 2018.
 
2.   Board of Supervisors - Approve appointment of Cal Willahan as a member of the Board of Adjustments and Appeals, representing District 5. Term set to expire June 30, 2021.
 
3.   Board of Supervisors - The Board of Supervisors will resolve into the Board of Directors of the Seligman Sanitary District, and following consideration of this item(s) will reconvene into the Board of Supervisors - Approve and execute a pipeline license from BNSF Railway Company, necessary to construct Community Development Block Grant (CDBG) funded improvements to an existing sanitary sewer pipeline that passes under the BNSF railroad tracks in Seligman, AZ. 4.   Board of Supervisors - Approve vouchers for July 23, 2018 through August 3, 2018.
 
5.   County Attorney - Approve Waiver of Conflict regarding a Lease Agreement between Mayer Unified School District No. 43 and Yavapai County for a Yavapai County Sheriff's Office substation at the Red Brick Schoolhouse in Mayer, Arizona.
 
6.   Development Services - Approve a subscription contract with Online Solutions LLC (DBA CitizenServe) for an online permitting system. YC Contract No. 2018-397 (All Districts)
 
7.   Development Services - Approve a Use Permit to allow the permitting of an existing 1908 sq. ft. guesthouse, encroaching approximately 5 ft. into the front setback, on an approximate 1.63 acre parcel in a R1L-18 (Residential; Single Family Limited to site built structures only) zoning district; subject to the recommended stipulations; Jason Thompson, Rebecca Simmons-Thompson, Jack Simmons, The Jack Simmons Family Trust; 406-45-104G; HA# H18029. The property is located on E. Kerley Lane off E. Franquero Lane in the Cottonwood area. S35 T16N R03E G&SRB&M (District 3 - Supervisor Garrison)
 
8.   Elections - Approve Election Services IGA with the following school districts: Bagdad Unified School District #20 - YC Contract No. 2018-316, Camp Verde Unified School District #28 - YC Contract No. 2018-390, Congress Elementary School District #17 - YC Contract No. 2018-391, Kirkland Elementary School District #23 - YC Contract No. 2018-392, Mingus Union High School District #4 - YC Contract No. 2018-393, and Williamson Valley Elementary School District #2 - YC Contract No. 2018-330
 
9.   Elections - Approve Election Services Intergovernmental Agreement with the following special districts: Yarnell Fire District - YC Contract No. 2018-381, Ash Fork Sanitary District - YC Contract No. 2018-385, Diamond Valley Water District - YC Contract No. 2018-386, Mayer DWID - YC Contract No. 2018-394, Ponderosa Park DWID - YC Contract No. 2018-387, Central Yavapai Hospital District - YC Contract No. 2018-388, and Sheriff's Posse Community RIMD - YC Contract No. 2018-389
 
10.   Finance - Approve certification that the total revenue collected by the Superior Court, Clerk of the Court and the Justice Courts in fiscal year 2017-18 of $8,224,124.20 (the 2016-17 amount was $8,513,159.55) is greater than the base year collections in fiscal year 1997-98 of $3,407,339.18, in accordance with A.R.S. §41-2421 (All Districts).
 
11.   Flood Control District - The Board of Supervisors will resolve into the Board of Directors of the Yavapai County Flood Control District, and following consideration of these items will reconvene as the Board of Supervisors - Approve an Authorization of Services for construction of a low water crossing on Beasley Flat Road through the State of Arizona Statewide General Contractor Job Order Contract using Fann Contracting, Inc., totaling $237,805.24. 12.   Flood Control District - The Board of Supervisors will resolve into the Board of Directors of the Yavapai County Flood Control District, and following consideration of this item will reconvene as the Board of Supervisors - Approve a professional services contract with Kimley-Horn and Associates, Inc. for the Diamond Valley Flood Mitigation Study and Alternatives Analysis, in an amount of $26,700.00. 13.   Flood Control District - The Board of Supervisors will resolve into the Board of Directors of the Yavapai County Flood Control District, and following consideration of this item will reconvene as the Board of Supervisors - Approve a Professional Services Contract with Atkins North America, Inc. for Cherry and Cienega Creeks FEMA Zone A Floodplain Delineation Study, in the amount of $55,940.00. 14.   Jail District - The Board of Supervisors will resolve into the Board of Directors of the Yavapai County Jail district and following consideration of this item, will reconvene as the Board of Supervisors - Approve use of existing Jail District Budget capacity from FY 17/18 to pay for the 2nd and final installment for the Jail Management System Data Conversion in the amount of $34,439.00.
 
15.   Library District - The Board of Supervisors will resolve into the Board of Directors of the Yavapai County Free Library District, and following consideration of this item will reconvene as the Board of Supervisors - Approve a two year agreement with Proquest LLC for the continued use of Ebook Central in the amount of $53,544.01, effective July 1, 2018. 16.   Public Works - Approve an Authorization of Services for construction of a restroom and terminal building at Bagdad Airport through the State of Arizona Statewide General Contractor Job Order Contract using SD Crane Builders, Inc., totaling $281,724.14. YC Contract No. 2018-367; and approve Authorization of Services No. 1822864 for construction management services with C&S Engineers, Inc. for $9,310.00. 17.   Public Works - Approve Authorization of Services No. 1822047.1 with ATL-CMT in the amount not to exceed $47,691.00 for quality control testing on the upcoming Overlay (Fall, FY 2018-2019) in Yavapai County, AZ - Project #1822047. 19.   Public Works - Approval to apply for a Right of Way Grant from the Bureau of Land Management for S. Bradshaw Mountain Ranch Road from its intersection with Crown King Road to the border of the Bradshaw Mountain Ranches Subdivision. (District 2 - Supervisor Thurman)
 
20.   Public Works - Approve Federal Aviation Administration (FAA) Grant Offer 3-04-033-24-2018 in the amount of $410,654.00, and approve the Letter of Acceptance for the Sedona Airport Oak Creek Airport Authority (SOCAA) for their match of $20,158.00. 21.   Public Works - Approve Cultural Resource Manager, Kathryn Turney, to attend a conference on cultural resources law and tribal consultation in Scottsdale, Arizona, October 10-12, 2018, at We-Ko-Pa Resort using a Yavapai County vehicle. (All Districts)
 
22.   Public Works - Approve one-year contract extensions for On Call Professional Geotechnical Engineering Services in Yavapai County, AZ - Contract #1519411 with various engineering firms. YC Contract No. 2018-375 to 2018-380 (All Districts)

35.   Sheriff - Approve three-year Intergovernmental Agreement with the Town of Dewey-Humboldt and the Sheriff's Office for law enforcement services. YC contract No. 2018-344
 
36.   Sheriff - Approve contract for vehicle towing and storage services with the following vendors: Murphy's Tow and Automotive Services - YC Contract No. 2018-355; Arizona Recovery and Towing - YC Contract No. 2018-360; TNT Towing LLC - YC Contract No. 2018-370
 
37.   Sheriff - Approve two (2) employees to take one county vehicle out of state to attend Force Science training in Henderson, Nevada on November 12-16, 2018.
 
ACTION
 
1.   Board of Supervisors - Set primary and secondary property tax rates for 2018 for the following jurisdictions: Yavapai County, Fire District Contribution, Yavapai County Free Library District, Yavapai County Flood Control District, Ash Fork Street Lighting Improvement District, Seligman Street Lighting Improvement District, Yarnell Street Lighting Improvement District and Seligman Sanitary District and convey tax rates for all jurisdictions to the County Treasurer. Adopt Resolution No. 1988 providing for the collection of taxes for all jurisdictions by the County Treasurer for fiscal year 2018-2019. Phil Bourdon, County Administrator Approved

HEARINGS
 
1.   Community Health Services - Courtesy hearing for adoption of revised Yavapai County Health Code last adopted April 6, 2015. The code serves as a local ordinance in terms of licensing and regulating establishments under Yavapai County’s public health jurisdiction. Adoption includes the 2017 FDA Food Code. Final hearing and adoption will be September 5, 2018, and will go into effect January 1, 2019. No vote needed for courtesy hearing. No Action
 
STUDY SESSION
 
1.   Board of Supervisors - Study Session to discuss Yavapai County hosting the 2020 or 2021 County Supervisors Association Legislative Summit. No Action
 
2.   Human Resources - Discussion on an automated external defibrillator (AED) program for County buildings. (All Districts) No Action
 
CALL TO THE PUBLIC: Individuals may address the Board for up to three (3) minutes on any relevant issue within the Board's jurisdiction. Pursuant to A.R.S. §38-431.01(H), Board members shall not discuss or take action on matters raised during the call to the public. 1.   Board of Supervisors - Convene into executive session pursuant to A.R.S. §38-431.03(A)(1) to discuss and conduct performance appraisals of the Library District Director, Human Resources/Risk Management Director and County Administrator.
 
2.   Board of Supervisors - Convene into executive session pursuant to A.R.S. §38-431.03(A)(3) and (A)(4) for legal advice, consultation and discussion regarding transit service related contracts.
 
3.   Board of Supervisors - Convene into executive session pursuant to A.R.S. §38-431.03 (A) (7) for discussion regarding negotiations for the purchase, sale or lease of real property.
 
4.   Board of Supervisors - Convene into executive session pursuant to A.R.S. §38-431.03(A)(3) and (A)(4) for legal advice, consultation and discussion regarding solar panel claims and lawsuits, including Solar City, et al v. Arizona Department of Revenue, et al, TX2018-000905.
