Development Services - Approval of a Use Permit Amendment to allow for the continued operation of an American Legion post with service of alcohol and food with special events and meetings on an approximate 1.55 acre parcel in a RCU-2A (Residential, Single Family, 2-acre min lot size) zoning district. Wickes Family Trust; American Legion Post 139; APN: 204-04-064P; HA# H16090.  The property is located between S Gladiator Mine Road and E Crown King Road, approx. 2,000 ft. northwest of the intersection of E Crown King Road and Main Street in the Crown King area. Brief Explanation of Need
On February 2, 2017, the Planning and Zoning Commission recommended approval of the Use Permit Amendment, HA#16090, with the stipulations as amended. 1. Use Permit Amendment allow for the continued operation of an American Legion Post in a detached building with service of alcohol, food and special events, for members and the general public. 2. Property to be maintained in conformance with the site plan dated November 9, 2016, in accordance with all applicable codes, regulations and ordinance requirements. 3. Use Permit approval to be in compliance with Section 582 Use Permits. 4. Applicant to apply for and diligently pursue completion of a “commercial change of use” by March 9, 2017. The “commercial change of use” must be completed prior to initiation of the use. 5. Waiver of paving the parking area to allow for existing surface. decomposed granite. 6. Waiver of solid screening and commercial landscaping requirements to allow for existing natural vegetation. 7. Any future expansion of use will require an amendment to this Use Permit. 8. In the event the owner of the subject property files a claim under ARS Section 12-1134 regarding this Use Permit, this Use Permit shall be null and void. *Verbiage per the Commission. The vote was unanimous.
