Development Services - Consideration of Use Permit to allow an existing 948 sq. ft. studio/storage/garage to be permitted as a guesthouse. This structure encroaches approximately 20 feet into the required 30-foot rear setback on an approximate 20,037 sq. ft. (0.46 acre) parcel in an R1L-35 (Residential; Single Family Limited to site built structures only) zoning district. Paul and Milana Yakubov; APN 405-32-171; HA# H18041. Located in the Pine Valley subdivision at the end of Jacks Canyon Road in the Village of Oak Creek. S09 T16N R06E G&SRB&M (District 3 - Supervisor Garrison)
Brief Explanation of Need
On December 20, 2018, the Planning and Zoning Commission voted on a motion for recommendation to deny Use Permit HA#18041. The vote was unanimous.

Should the Board decide to approve the Use Permit, H18041, the following conditions of approval might also be considered.
  1. Use Permit to allow for a 948 square foot detached guesthouse encroaching approximately 20 feet into the required 30-foot rear setback, to be approved on a permanent basis.
  2. Property to be developed in accordance with the site plan submitted with the Use Permit application and in accordance with all applicable codes, regulations and ordinance requirements.
  3. In the event the owner of the subject property files a claim under ARS Section 12-1134 regarding this Use Permit, this Use Permit shall be null and void.
  4. Any future expansion of use or structure will require an amendment to this Use Permit.
  5. Applicant to submit for a building permit for the guesthouse within 3 months of Board of Supervisors approval.
  6. Certificate of Compliance to be issued within 6 months of Board of Supervisors approval confirming that all stipulations have been satisfied, the use is operating in conformance with all approvals, and in conformance with all applicable County, State and Federal regulations or the Use Permit will become null and void.
