Public Works - Approve acceptance of a realigned Utility Easement and approve Resolution No. 1998 to extinguish a portion of an existing Utility Easement located within the Granite Park Subdivision, Granite Dells. (District 4 – Supervisor Brown)
Brief Explanation of Need
In 1984, the City of Prescott and Yavapai County entered into an Intergovernmental Agreement to extend the City's water system into the Granite Gardens Subdivision. In 1985, the owners of the property that is now the Granite Park Subdivision granted the County a Utility Easement for the project. Thereafter, a City water main and a gas main were constructed in the easement.

The owners of Assessor's Parcel Number 106-10-158A, the Perrys, are planing to build a new house on their property, which the easement traverses; however, the location they have chosen for their build slightly encroaches on the easement. The Perrys have granted a new easement that is contiguous with the old easement but deviates approximately 4 feet south of a small portion of the old easement.

The Perrys are requesting that the County accept the new grant of easement and extinguish that portion of the old easement that lies north of the new easement so that their new house will not be encroaching on the realigned easement. The City and Unisource Energy Services have approved the realignment of the easement, as the water and gas mains remain well within the new easement.

The Public Works Department respectfully requests that the Yavapai County Board of Supervisors approve acceptance of the new Utility Easement and approve Resolution No. 1998, extinguishing that portion of the old easement that lies north of the new easement.
