SUPERVISORS' REPORTS AND COUNTY ADMINISTRATOR'S REPORT
Pursuant to A.R.S. §38-431.02(K), individual Supervisors and the County Administrator may present brief summaries of current events but no discussion may occur and no action may be taken regarding anything that is presented.
 
CALL TO THE PUBLIC: Individuals may address the Board for up to three (3) minutes on any relevant issue within the Board's jurisdiction. Pursuant to A.R.S. §38-431.01(H), Board members shall not discuss or take action on matters raised during the call to the public. The Board may direct staff to study the matter or direct that the matter be rescheduled for consideration at a later date.
 
AWARDS AND PROCLAMATIONS 
 
1.   Board of Supervisors - Approve a proclamation commending Yavapai County Citizens for their support of liberty and community betterment in conjunction with Martin Luther King Jr. Day/Civil Rights Day. Approved
 
CONSENT AGENDA All items on the Consent Agenda were unanimously approved.
 
1.   Board of Supervisors - Approve minutes of meeting of January 2, 2019.
 
2.   Board of Supervisors - Approve settlement of a property tax appeal, and the refund of the overpayment of taxes pursuant to A.R.S. §42-16214 in the following case: Wilhelm v. Yavapai County (ST2018-000151).
 
3.   Board of Supervisors - Approve Memorandum of Understanding (MOU) between the Yavapai-Prescott Indian Tribe and Yavapai County to act as a pass-through agency for a contribution of funds to Horses with Heart and the Williamson Valley Fire District. YC Contract No. 2019-006
 
4.   Board of Supervisors - Approve transfer of funding from the General Fund to the Superior Court Fill-the-Gap fund in the amount estimated to be $24,556.00 to cover a Paid Time Off (PTO) payout due to a retirement.
 
5.   Board of Supervisors - Approve vouchers for December 24, 2018 through January 4, 2019.
 
6.   Community Health Center - Approve three (3) employees to take a County vehicle out of state to attend the NextGen Template Editor/Document Builder training in Irvine, California on February 10-16, 2019.
 
7.   Fleet Management - Approve final purchase of replacement vehicles for General Fund and HURF funds from fiscal year 2018/2019 using the Arizona Counter Drug Procurement program. (All Districts)
 
8.   Flood Control District - The Board of Supervisors will resolve into the Board of Directors of the Yavapai County Flood Control District, and following consideration of this item will reconvene as the Board of Supervisors - Approve out of state travel, lodging, per diem costs, and registration for Tony Anguiera to attend the HydroLynx/TriLynx training class in Sacramento, California from April 16-19, 2019.
 
9.   Flood Control District - The Board of Supervisors will resolve into the Board of Directors of the Yavapai County Flood Control District, and following consideration of this item will reconvene as the Board of Supervisors - Approve Professional Services contract in the amount of $59,400.00 with Shephard Wesnitzer, Inc. to provide planning and design services to determine ideal locations for green infrastructure projects, identify projects that would yield the most benefit, and to create the design documents, maintenance plan, and schedule. 10.   Public Works - Approve acceptance of Public Roadway Easement for donated right-of-way for South Overland Road in the Government Canyon area. (District 1 - Supervisor Simmons)
 
11.   Public Works - Approve acceptance of Public Roadway Easement for donated right-of-way for Cemetery Road in Ash Fork. (District 4 - Supervisor Brown)
 
12.   Public Works - Approve acceptance of donated Public Roadway Easement and Sight Distance Easement in Prescott East Unit 1 Subdivision. (District 5 - Supervisor Smith)
 
13.   Public Works - Approve the execution of a purchase agreement for the acquisition of right-of-way on East Sunset Lane. YC Contract No. 2019-007 (District 5 - Supervisor Smith)
 
14.   School Superintendent - Approve agreements for E-rate Consulting Services between the Yavapai County School Superintendent and the following entities: Berean Academy, YC Contract No. 2019-008 and Griffin Foundation, YC Contract No. 2019-009.
 
15.   Sheriff - Approve Constable Training for Deputy Winkles by the Arizona Constables Association in Tubac, Arizona on January 14-17, 2019.
 
16.   Sheriff - Approve one (1) employee to take a County vehicle out of state to attend Legal Trends & Liability Management for Tactical, SWAT & Emergency Response Operations in Las Vegas, Nevada from February 4-7, 2019.
 
17.   Sheriff - Approve Agreement between the National Council for Behavioral Health and Yavapai County to provide youth and adult Mental Health First Aid Instructor Certification for fifteen (15) participants. YC Contract No. 2019-010
 
18.   Sheriff - Approve acceptance of the 2019 ACJC/Residential Substance Abuse Treatment program Grant award number RSAT-19-006. YC Contract No. 2019-021
 
19.   Sheriff - Approve Capital Equipment purchase of one gas Combi Oven for the Verde Detention Center from Western Foodservice Equipment in the amount not to exceed $20,895.45.
 
HEARINGS
 
1.   Development Services - Consideration of Use Permit to allow an existing 948 sq. ft. studio/storage/garage to be permitted as a guesthouse. This structure encroaches approximately 20 feet into the required 30-foot rear setback on an approximate 20,037 sq. ft. (0.46 acre) parcel in an R1L-35 (Residential; Single Family Limited to site built structures only) zoning district. Paul and Milana Yakubov; APN 405-32-171; HA# H18041. 2.   Development Services - Consideration of a Wireless Use Permit to allow for an 80' tall co-locatable broadleaf tree with supporting equipment on a portion of an approximate 4.48-acre parcel in a C2-1 (Commercial; General Sales and Services, 7,500 sq. ft. minimum lot size) zoning district and a waiver from setbacks with a proof of collapse, a waiver of new wireless facilities being built within 1,000 feet of residences, with the recommended stipulations; Donegal Properties, LLC; FM Group for AT&T Mobility; Michael Campbell; APN: 40829-003K; HA# H18049. PRESENTATIONS
 
1.   Board of Supervisors - Presentation by Nicole Branton, Coconino National Forest Red Rock District Ranger, regarding the Fossil Creek Comprehensive River Management Plan Draft.
 
2.   Board of Supervisors - Presentation by Mary Chicoine, Administrator and Robyn Prud'homme-Bauer, Chair of the Verde Valley Regional Economic Organization (VVREO). The presentation will include the VVREO Economic Development Strategic Plan and Process.
 
EXECUTIVE SESSION
 
1.   Board of Supervisors - Convene into executive session pursuant to A.R.S. §38-431.03 (A) (7) for discussion regarding negotiations for the purchase, sale or lease of real property.
 
2.   Board of Supervisors - Convene into executive session pursuant to A.R.S. §38-431.03 (A)(3) and (A)(4) for legal advice/consultation on claims and lawsuits.

1.   Board of Supervisors - Consider such action as may be required regarding purchase, sale or lease of real property. No Action
