BOARD OF SUPERVISORS AGENDA-2018
Meeting Date: 01/03/2018
Submitted For: Dan Cherry
Department: Flood Control

Action Requested
Flood Control District - The Board of Supervisors will resolve into the Board of Directors of the Yavapai County Flood Control District, and following this hearing will reconvene as the Board of Supervisors - Hearing to present, discuss, and consider adoption of the Yavapai County Flood Control District 2018-1 Flood Damage Prevention Ordinance, which replaces the 2010-1 Flood Damage Prevention Ordinance.
Brief Explanation of Need
The Yavapai County Flood Control District has prepared a revised 2018-1 Flood Damage Prevention Ordinance to replace its existing 2010-1 Ordinance, at the behest of the Federal Emergency Management Agency, the Arizona Department of Water Resources, and the Arizona National Flood Insurance Program Coordinator’s office. As part of maintaining good standing in the National Flood Insurance Program (NFIP), the District occasionally needs to update its Ordinance that regulates development within floodplains. Most of the changes in this Ordinance update reflect language changes to align it with Arizona State Statues and to closely match the latest version of the Arizona State Model Flood Damage Prevention Ordinance. There are some general ‘housekeeping’ items that are being corrected in the Ordinance language, as well, for sake of clarification.
With updated floodplain maps being published by FEMA in March 2018, the Flood Control District and its governing Board have been requested to review, update, approve and have effective a new Ordinance prior to March 6, 2018. The Arizona NFIP coordinator’s office and Director of ADWR are aware of these revisions, having been notified prior to the minimum time frame required before the formal hearing, and find them to satisfy the requirements of the Ordinance update.
Per Section 7.2 of the existing Ordinance, Public Notice has been published on December 3-6, 2017, to announce this formal hearing and potential adoption on January 3, 2018. A courtesy hearing to present this Ordinance update was held on December 20, 2017, at the Board of Supervisors meeting in Cottonwood, AZ. A marked-up copy of the existing Ordinance is provided as an attachment, to make clear just what has changed from the currently effective Ordinance, as is a final, formatted copy as proposed. Copies of the Ordinance are available to the public for viewing in either Cottonwood or Prescott Flood Control District Offices. With adoption of the Ordinance on January 3, 2018, the new Ordinance would become effective 30 days later on February 3rd, 2018.
